Two Polk County residents are now facing charges of manufacturing marijuana after a tip from a concerned citizen led deputies to a residence and property where marijuana was being manufactured.
Polk County deputies executed a search warrant at a residence on McKibben Road in the Dugdown Mountain area Wednesday afternoon. Approximately 60 marijuana plants were confiscated during the search. The street value of the marijuana has not been determined at this time.
Cody Lee Ferguson and his wife Shelby Ferguson were both arrested and charged with felony marijuana manufacturing. Both Cody and Shelby remain in custody at the time of this publication.
Shelby has a property bond set at $1,100 while Cody has a property bond set at $5,100.
In the state of Georgia, possession of more than one ounce of marijuana with or without intent to distribute is a felony crime punishable by imprisonment from one to ten years with no maximum fine limit.
Arrest reports do not reflect the guilt or innocence of the individuals listed. All parties are presumed innocent until proven guilty in a court of law. Not every arrest/charge leads to a conviction. A conviction or acquittal is determined by the court system.
